Neighbourhood Disputes about Plants Act 2017
The Resource & Planning Stream of the Tasmanian Civil & Administrative Tribunal (TASCAT) can help resolve neighbourhood plant disputes under the Neighbourhood Disputes About Plants Act 2017 if you are not able to resolve it informally with your neighbour.
Resolving the dispute informally
First we suggest you read the information on neighbourhood disputes about plants (external link) and recommendations for resolving them informally.
If you are unable to resolve the issue with your neighbour informally, you can file an application with the Tribunal.
TASCAT can make a legally enforceable decision on the matter. However applying to the Tribunal should be seen as a last resort. It’s always better if you and your neighbour can resolve the problem together and stay on good terms.
Filing a dispute with the Tribunal
Firstly, please read Information Sheet 12 which provides guidance on making an application to file a dispute with the Tribunal.
Then fill out and submit the appropriate application form.
Searching the database
You can request the Tribunal search its database for orders made under the Act. The Tribunal must receive payment before conducting the search.
Submit your search request and payment by credit card This is our preferred method of applying for a Database search.
Alternatively, you can download the Application to search database form (DOCX, 47.4 KB), complete it and lodge it in person with your cheque or cash at any Service Tasmania shop.
