Important Update - 1 July 2025
Please note, on 1 July 2025 amendments to the Tasmanian Civil and Administration Act 2020 took effect because of the proclamation of the Tasmanian Civil and Administrative Tribunal (Additional Jurisdictions) Act 2024. Three amendments directly relate to the RPS:
- The Forestry Practices Stream has been merged into the Resource and Planning Stream.
- Clause 9(1), (2) and (3) of Schedule 2, Part 8 of the Tasmanian Civil and Administrative Tribunal Act 2020, have been omitted.
- Four new Acts have been added to the RPS that have been transferred from the Administrative Appeals Division of the Magistrates Court (Abandoned Lands Act 1973; Crown Lands (Shack Sites) Act 1997; Forestry (Fair Contract Code) Act 2001; Roads and Jetties Act 1935. Details of those review rights are available in the information about making an application.
There have been no changes to the statutory settings of forestry practices matters and they will continue to be heard and determined in the same manner as before 1 July 2025. They are now housed in a single Stream.
Changes to listing practices arising from the removal of Clause 9(1), (2) and (3) of Schedule 2, Part 8 have been included in updated Fact Sheets and Practice Directions.
Resource and Planning Stream
The Resource and Planning Stream of TASCAT resolves appeals and applications regarding a wide range of administrative acts and decisions. The Tribunal can also make orders protecting environmental or planning rights and values.
The website contains information to assist parties when appearing in the Resource and Planning Stream of TASCAT.
The information sheets and practice directions are important documents which set out both procedural information and requirements for processes of the Tribunal. It is important that persons who are parties to proceedings take the time to read those documents.
When the Tribunal receives an application, it will follow a process of determining the application which includes:
- notifying relevant people about the application
- providing directions about preparing for a hearing
- listing the application for a hearing
- conducting the hearing and making a decision.
This website provides information about:
- the different types of applications that the Resource & Planning Stream can receive.
- how someone can make the applications.
- the things people need to do if they are part of the proceedings; and
- how the application will be determined.
- Where you can get assistance and advice
- What you can do if you disagree with a decision of the Tribunal
