Important Change to Instruments of Enduring Guardianship Forms

On 21 November 2022 amendments to the Guardianship and Administration Act 1995 came into effect to implement the Advanced Care Directive reforms of the Tasmanian Government.

Those amendments imposed an additional requirement for making an Instrument of Enduring Guardianship.  This requirement is mandatory for making a valid Instrument of Enduring Guardianship.

Under Section 32(2)(b)(ii) of the Guardianship and Administration Act 1995 now provides:

  • (ii) a declaration in the form, or to the effect, of the declaration specified in Form 1 signed by each person appointed as an enduring guardian, that the person has obtained and understood any advance care directive given by the appointor; and...

The Tribunal issued amended forms for registering Instruments of Enduring Guardianship to incorporate this new requirement. View  the amended form for Instrument of Enduring Guardianship and relevant fact sheet.
