If a medical question arises in any proceedings before the Tribunal the Tribunal may determine the question on the evidence presented or notify the Asbestos Compensation Commissioner that the Tribunal requires the Asbestos Compensation Commissioner to refer the medical question to a Medical Panel.

If the Tribunal notifies the Asbestos Compensation Commissioner that a Medical Panel is required the Asbestos Compensation Commissioner must refer the question to a medical panel under section 47 and notify the Tribunal as soon as it receives the determination from the panel.

The Tribunal is to give the weight it thinks fit to the determination of a Medical Panel given under section 60(3)(a). See sections 60, 61, 62, 63, 64 and 65 for further information about Medical Panels.
